2. APPLICATION OF THESE TERMS
By placing an order through our website, you agree to these Terms.
These Terms apply to all sales of artwork, sculptures, commissions, and related products sold through our website.
3. OUR ARTWORK
All sculptures are handmade and individually produced.
Due to the artistic and handcrafted nature of our work, dimensions, finishes, patinas, colours, textures, weld marks, and other visual characteristics may vary from photographs and descriptions. Such variations form part of the character of the artwork and do not constitute defects.
Images on our website are intended for illustration purposes only.
4. PLACING AN ORDER
When you place an order, you are making an offer to purchase the artwork.
A contract is formed only when we send written confirmation that we have accepted your order.
We reserve the right to decline any order where:
* The artwork is unavailable;
* Payment cannot be authorised;
* There has been a pricing or description error;
* Fraud or misuse is suspected.
5. PRICE AND PAYMENT
All prices are shown in Pounds Sterling (£) unless otherwise stated.
Prices include VAT where applicable.
Delivery charges, installation charges, customs duties, import taxes, and similar costs are additional unless expressly stated otherwise.
Payment must be received in full before dispatch unless otherwise agreed.
6. DELIVERY
We will make reasonable efforts to deliver within the times stated on our website or in correspondence.
Delivery dates are estimates and are not guaranteed.
Risk in the artwork passes to you upon delivery to the address supplied by you.
Ownership of the artwork passes only when full payment has been received.
You should inspect the artwork upon delivery and notify us of any damage within 48 hours where reasonably possible.
7. YOUR RIGHT TO CANCEL – STANDARD WEBSITE PURCHASES
For sculptures purchased online that are not custom-made or commissioned, consumers may have the right to cancel within 14 days of receiving the artwork under the Consumer Contracts Regulations 2013.
To exercise this right, you must notify us clearly in writing before the cancellation period expires.
You must return the artwork in its original condition and packaging (where reasonably possible).
Unless the artwork is faulty or incorrectly supplied, you are responsible for return shipping costs.
Refunds will be made within 14 days of receiving the returned artwork or receiving evidence that it has been returned.
8. EXCEPTION FOR COMMISSIONED AND CUSTOM-MADE WORK
The statutory cancellation right does not apply to goods made to a customer's specification or clearly personalised.
Accordingly, commissioned, bespoke, personalised, or custom-made sculptures cannot be cancelled once production has commenced unless otherwise agreed in writing or required by law.
Deposits paid for commissioned work are non-refundable once design or fabrication work has begun.
9. COMMISSIONS
Where a sculpture is commissioned:
a. We may require a deposit before work begins.
b. Design sketches, models, concepts, and proposals remain our intellectual property.
c. Completion dates are estimates only.
d. Minor artistic or fabrication variations may occur during production.
e. Final payment must be received before delivery unless otherwise agreed.
10. FAULTY OR DAMAGED ARTWORK
Under the Consumer Rights Act 2015, consumers are entitled to receive goods that are:
* Of satisfactory quality;
* Fit for purpose;
* As described.
If an artwork is faulty, damaged, or not as described, please contact us promptly.
Where required by law, we will repair, replace, or refund the artwork.
Nothing in these Terms limits your statutory rights.
11. INTELLECTUAL PROPERTY
All copyright, design rights, moral rights, photographs, website content, and artistic rights relating to our sculptures remain our property unless expressly assigned in writing.
Purchase of a sculpture transfers ownership of the physical artwork only.
No reproduction, casting, manufacturing, copying, scanning, commercial photography, merchandising, or other exploitation rights are granted.
12. INSTALLATION AND SAFETY
Customers are responsible for ensuring that artwork is installed, mounted, displayed, and maintained safely.
Any installation advice provided by us is given in good faith.
We accept no liability for damage or injury resulting from improper installation, misuse, alteration, neglect, or unauthorised modification of the artwork.
13. LIMITATION OF LIABILITY
Nothing in these Terms excludes or limits liability for:
* Death or personal injury caused by negligence;
* Fraud or fraudulent misrepresentation;
* Any liability that cannot legally be excluded.
Subject to the above, our liability shall be limited to the purchase price paid for the artwork.
We shall not be liable for indirect or consequential losses including loss of profit, business interruption, loss of opportunity, or loss of goodwill.
14. EVENTS OUTSIDE OUR CONTROL
We shall not be liable for delays or failures caused by events beyond our reasonable control, including supplier failures, transport disruption, industrial action, severe weather, natural disasters, pandemics, government action, or similar circumstances.
15. PRIVACY
We process personal information in accordance with our Privacy Policy and applicable UK data protection legislation.
16. GOVERNING LAW
These Terms are governed by the laws of England and Wales.
The courts of England and Wales shall have jurisdiction over any dispute arising from these Terms, except where consumer protection laws provide otherwise.
